1. About CarFinanceGTA

CarFinanceGTA.com ("CarFinanceGTA", "we", "us", "our") is an automotive financing broker service operating in the Greater Toronto Area and across Ontario, Canada. We are not a lender, credit grantor, or financial institution. We do not make credit decisions. We act as an intermediary connecting consumers with a network of automotive lending partners and dealerships.

Use of this website and submission of any application constitutes your agreement to these Terms of Service.

2. Eligibility

To use our services you must:

• Be at least 18 years of age
• Be a resident of Ontario or another Canadian province
• Have a valid Canadian phone number
• Provide accurate and truthful information

3. Nature of Our Service

CarFinanceGTA provides a lead generation and referral service. Specifically:

• We collect your information and share it with lending partners and dealerships in our network
• We do not guarantee financing approval, specific interest rates, or loan terms
• All financing is subject to lender approval and their individual criteria
• Rates and terms vary based on your credit profile, income, and lender criteria
• We do not control the decisions made by lending partners
• We are not responsible for the products, services, or conduct of any lending partner or dealership

4. Accuracy of Information

You agree to provide accurate, current, and complete information when using our service. Providing false or misleading information may result in your application being rejected and could constitute fraud under applicable Canadian law. We reserve the right to refuse service to anyone who provides inaccurate information.

5. Communications Consent

By submitting your application, you expressly consent to:

• Being contacted by CarFinanceGTA and our lending partners by phone, email, and SMS regarding your financing inquiry
• Receiving a one-time SMS verification code to confirm your phone number
• Receiving transactional messages related to your application status

You may opt out of SMS communications at any time by replying STOP. Standard message and data rates may apply. Our communications comply with Canada's Anti-Spam Legislation (CASL).

6. Privacy

Your use of our service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and use your personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

7. No Credit Impact Representation

Submitting your information through our website constitutes a soft inquiry only and will not affect your credit score. However, if a lending partner proceeds with a formal credit application on your behalf, they may conduct a hard credit inquiry which could affect your credit score. We will inform you before this step occurs.

8. Intellectual Property

All content on this website including text, graphics, logos, and code is the property of CarFinanceGTA.com or its content suppliers and is protected by applicable Canadian intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that financing will be available or that you will receive any particular rate or term.

10. Limitation of Liability

To the maximum extent permitted by Ontario and Canadian law, CarFinanceGTA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our service, including but not limited to financing decisions made by lending partners, loss of data, or interruption of service.

Our total liability to you for any claim arising from use of our service shall not exceed the amount, if any, you paid to use the service (which is zero, as our service is free to consumers).

11. Indemnification

You agree to indemnify and hold harmless CarFinanceGTA and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of our service, your violation of these Terms, or your provision of false information.

12. Third-Party Services

Our service integrates with third-party providers including Twilio (SMS), Resend (email), and Cloudflare (hosting and security). Your use of our service is subject to the terms and privacy policies of these providers. We are not responsible for the actions or policies of these third parties.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of our service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our service after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
